Terms and Conditions
§ 1 Scope
These General Terms and Conditions apply to all orders placed by consumers via the online shop (www.nytetools.com) of NYTE Europe GmbH, Martin-Hoffmann-Str. 11, 12435 Berlin, Germany (hereinafter referred to as the "Seller").
Deviating terms and conditions of the buyer will not be recognized unless the seller expressly agrees to their validity in writing.
Every translation of our texts, especially our policies and conditions, has been prepared with the greatest possible care. However, only the German version is decisive for all texts on this online shop, so that only this is accessible for interpretation.
§ 2 Contractual partner, conclusion of contract
The purchase contract is concluded with NYTE Europe GmbH.
By clicking on the "order with obligation to pay" button or corresponding buttons, the buyer makes a binding offer to purchase the goods contained in the shopping cart.
The Seller will promptly send the Buyer a confirmation of receipt of the order by e-mail ("Order Confirmation"). The purchase contract is concluded with this order confirmation.
§ 3 Prices and shipping costs
All prices are final prices in EUR incl. VAT and plus shipping costs, unless otherwise stated.
The shipping costs as well as any payment or delivery terms will be displayed to the buyer during the order process.
Unless otherwise specified, delivery will be made within the European Union.
§ 4 Delivery, availability
Delivery will be made to the delivery address within the EU specified by the buyer.
Information on the delivery time is non-binding, unless bindingly stated as such.
If an ordered product is not available (e.g. sold out), the buyer will be informed immediately. Payments already made will be refunded immediately.
§ 5 Payment
Payment is made using the payment methods offered in the online shop (e.g. PayPal, credit card, instant bank transfer, etc.).
If payment is selected in advance, payment is due upon conclusion of the contract.
§ 6 Ownership
The goods remain the property of the seller until full payment has been made. We do not agree to a resale in the meantime, but reserve the right to approve this against assignment of the resulting claim. Such approval must be in text form.
§ 7 Liability
The Seller shall be liable for damages resulting from injury to life, limb or health that are based on a negligent breach of duty as well as for other damages that are based on an intentional or grossly negligent breach of duty or a slightly negligent breach of a material contractual obligation.
In the event of a slightly negligent breach of non-material contractual obligations, the amount of liability is limited to the foreseeable damage typical for the contract.
Any further liability is excluded.
§ 8 Privacy
The seller processes personal data of the buyer within the framework of the legal provisions (e.g. GDPR) for contract processing, payment processing, shipping and marketing measures subject to consent. More information is available in the privacy policy.
§ 9 Final provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
For consumers residing abroad, the law of the respective EU member state applies.
Should any provision of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
Changes or additions to these T&Cs must be made in writing. This also applies to the amendment of this written form clause.
